Terms of Service

These Terms of Service ("Terms") govern your use of the Sportsgrove platform operated by Sportsgrove, LLC, a North Carolina limited liability company ("Sportsgrove," "we," "us," or "our").

By creating an account or using our platform, you agree to these Terms. If you are using Sportsgrove on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

1. Description of Service

Sportsgrove is a sports league management platform that enables organizations to manage leagues, tournaments, registrations, scheduling, and payments. The platform serves two types of users:

  • Organization Administrators - individuals who create and manage sports organizations, leagues, and tournaments
  • Players and Participants - individuals who register for leagues and tournaments through the platform

2. Accounts

Eligibility

You must be at least 18 years old to create an account. By creating an account you represent that you are at least 18 years old.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@sportsgrove.app if you suspect unauthorized access to your account.

Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to keep your information updated.

3. Organization Administrator Terms

If you create an organization on Sportsgrove, you agree to the following additional terms:

Responsibility for Your Organization

You are solely responsible for your organization's use of the platform, including the leagues you create, the registrations you collect, and the payments you process.

Player Data

As an organization administrator, you collect and process personal information from players who register for your leagues. You are a data controller for this information and are responsible for complying with applicable privacy laws. You agree not to use player data for any purpose other than administering your leagues and communicating with your players about their participation.

Youth Participant Data

If you run youth leagues, you are responsible for obtaining appropriate parental consent and handling minor participant data in compliance with COPPA and applicable law. You agree not to use youth participant data for any purpose other than administering youth leagues.

Payments

Sportsgrove processes payments on your behalf through Stripe Connect. You agree to Stripe's Connected Account Agreement. Registration fees collected through the platform are transferred to your connected Stripe account minus applicable platform fees. All fees are charged in USD.

Accurate Representation

You agree not to misrepresent your organization, leagues, or events to players. Registration fees collected must correspond to actual leagues and events.

Prohibited Organizations

You may not use Sportsgrove to operate organizations that engage in illegal activity, discriminate based on protected characteristics, or violate these Terms.

4. Payments and Fees

Platform Fees

Sportsgrove charges a platform fee on registrations processed through the platform. Current fee rates are displayed in your organization settings. We reserve the right to change our fees with 30 days notice.

Payment Processing

Payments are processed by Stripe. By using payment features, you agree to Stripe's Terms of Service.

Refunds

Refund policies for league registrations are set by organization administrators. Sportsgrove platform fees are non-refundable except where required by law.

Disputes

Payment disputes between players and organization administrators are the responsibility of the organization administrator. Sportsgrove is not responsible for resolving disputes about league fees, cancellations, or refunds.

5. Acceptable Use

You agree not to use Sportsgrove to:

  • Violate any applicable law or regulation
  • Infringe the intellectual property rights of others
  • Harass, abuse, or harm other users
  • Transmit spam or unsolicited communications
  • Collect user information without authorization
  • Attempt to gain unauthorized access to the platform or other users' accounts
  • Interfere with or disrupt the platform's operation
  • Use automated tools to access the platform without our permission
  • Impersonate another person or organization
  • Process payments for goods or services not delivered

6. Content

Your Content

You retain ownership of content you submit to the platform. By submitting content, you grant Sportsgrove a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to operate the platform.

Our Content

The Sportsgrove platform, including its design, code, and content, is owned by Sportsgrove, LLC and protected by intellectual property laws. You may not copy, modify, or distribute our platform or content without our written permission.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SPORTSGROVE DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SPORTSGROVE IS NOT RESPONSIBLE FOR THE CONDUCT OF ORGANIZATION ADMINISTRATORS OR PLAYERS, THE ACCURACY OF LEAGUE INFORMATION, OR THE SAFETY OF SPORTS ACTIVITIES CONDUCTED THROUGH LEAGUES MANAGED ON THE PLATFORM.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPORTSGROVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO SPORTSGROVE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.

9. Indemnification

You agree to indemnify and hold harmless Sportsgrove, LLC and its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time from your account settings.

Upon termination, your right to use the platform ceases. Provisions of these Terms that by their nature should survive termination will survive.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the platform shall be resolved in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Your continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
